- The property is currently leased by Gary Yoder, (“Tenant”) under an Agricultural Lease dated July 1st, 2021, (“Lease”) which expires November 30th, 2021. The successful Bidder is required to take possession of this property subject to the rights of the Tenant under the Lease. All expenses due and owing under the Lease by Seller have been paid by the Seller. If Closing occurs prior to expiration of the Lease, Seller will assign the Lease to the successful Bidder at Closing upon receipt of the Purchase Price. If the Lease is assigned at Closing, the successful bidder will receive income generated from the sale of the crops from the property under the Lease. Income will be based on a percentage of planted crop on the purchased property as a ratio to the total production of the property leased by the Tenant. The Lease was available to Bidder prior to the auction on CJ Auctions website and is enclosed in each Bidder’s packet, along with a copy of the Real Estate Purchase Contract.
- Parcels 1 & 2 have a total of 35.04 acres planted per the NAU Country Acreage Report, which report was made available to Bidder prior to Auction on CJ Auctions website, posted at the Auction and enclosed in each Bidder Packet. Seller makes no warranties or representations as to the accuracy of the NAU Country Acreage Report. If the Lease is assigned at Closing, Parcel 1 will be receiving 31% of the total income of the combined crop production of Parcels 1&2 and Parcel 2 will receive the remaining 69% of the total income of the combined crop production from Parcels 1&2. BOKF, NA, is making no warranty regarding the acreages of either Parcel 1 or 2 and there shall be no changes to these crop income percentages after the Auction.
- Seller’s crop insurance is currently in effect and the successful Bidder may be able to transfer Seller’s crop insurance by completing the appropriate paperwork and being approved by NAU Country. Seller is making no warranties regarding the successful Bidder’s acceptance under said policy with NAU Country. BOKF, NA, is making no warranty regarding the acreages of either Parcel 3 or 4 and there shall be no changes to these crop income percentages after the Auction.

- Buyer will receive Trustee’s Special Warranty Deed and title insurance.

How ‘Buyers Choice by the Acre’ works:
- Buyer’s choice may be offered when more than one property/parcel is being auctioned.
- Successful high bidder wins the right to choose a property/parcel or properties/parcels from a grouping of similar or like-kind properties.
- After high bidder selection, the property is deleted from the group and the bidding commences again.
- Process continues until all properties/parcels are selected.
- When selling by the acre, high bid is multiplied by the number of acres in the parcel.
